H-1B Employment-Based Visa

 

Our firm assists entities to secure the H-1B employment visa by navigating through related immigration issues with foreign consulates, labor laws, record keeping for audits, terminating foreign employees, and tax implications.

 In addition to assisting the employer hire a foreign-worker on a temporary or permanent basis, we also offer services to change employers, extend current H-1B visas, and file for green card (PERM) petitions. Visas for Professionals

H-1B (Dual Intent) Visa

Under the Immigration and Nationality Act, section 101(a)(15)(H), the H-1B non-immigrant visa allows U.S. employers to temporarily employ foreign workers in specialty occupations. The current law limits to 65,000 the number of aliens who may be issued a visa or otherwise provided H-1B status each fiscal year (FY). If a foreign worker becomes no longer employed in the H-1B status (quits or is dismissed from the sponsoring employer), the worker can find another employer, apply for a change of status to another non-immigrant status, or leave the US.

To qualify for this visa, the foreign worker must be employed in a specialty occupation, i.e. one that 1) requires "theoretical and practical application of a body of highly specialized knowledge in a field of human endeavor including, but not limited to, architecture, engineering, mathematics, physical sciences, social sciences, biotechnology, medicine and health, education, law, accounting, business specialties, theology, and the arts, and 2) requires the attainment of a bachelor's degree or its equivalent as a minimum (with the exception of fashion models, who must be "of distinguished merit and ability.)"  

Therefore, the foreign worker must possess at least a bachelor's degree or its equivalent and state licensure, if required to practice in that field. H-1B work-authorization is strictly limited to employment by the sponsoring employer.
